These Terms & Conditions govern your use of Bismej Tours' website and services. By booking a tour or using our website, you agree to these terms. Please read them carefully.
1. Definitions
- "We/Us/Our" refers to Bismej Tours SARL, registered in France
- "You/Client/Traveler" refers to any person booking or participating in our tours
- "Tour" refers to any travel package, activity, or service offered by us
- "Booking" refers to the reservation of a tour through our website, email, or phone
- "Force Majeure" refers to events beyond our reasonable control
2. Booking Process
2.1 Booking Requirements
To make a booking, you must:
- Be at least 18 years old (or accompanied by a legal guardian)
- Provide accurate and complete information
- Have a valid passport with at least 6 months validity beyond travel dates
- Obtain necessary visas and vaccinations
- Have travel insurance covering medical expenses and trip cancellation
2.2 Booking Confirmation
A booking is confirmed only when:
- We receive a completed booking form
- We receive the required deposit (30% of total price)
- We issue a booking confirmation email
2.3 Pricing
- All prices are in Euros (€) unless otherwise stated
- Prices are subject to change until full payment is received
- Price includes: Accommodation, transportation during tour, meals as specified, guided activities
- Price excludes: Flights to/from France, personal expenses, travel insurance, optional activities
3. Payments
3.1 Payment Schedule
- Deposit: 30% due at booking confirmation
- Balance: 70% due 60 days before departure
- Last-Minute Bookings: Full payment required for bookings made within 60 days of departure
3.2 Payment Methods
We accept the following payment methods:
- Credit/Debit Cards (Visa, MasterCard, American Express)
- Bank Transfers (SWIFT/IBAN)
- PayPal
- Apple Pay/Google Pay
3.3 Late Payments
If payment is not received by the due date:
- We reserve the right to cancel the booking
- Cancellation fees will apply as per section 4
- A €50 late payment fee may be charged
4. Cancellations & Refunds
4.1 Client Cancellations
Cancellation charges apply as follows:
More than 90 days before departure
Deposit (30%)
60-90 days before departure
50% of total price
30-59 days before departure
75% of total price
Less than 30 days before departure
100% of total price
Note: Some accommodations and services may have stricter cancellation policies.
4.2 Our Cancellations
We reserve the right to cancel a tour due to:
- Insufficient bookings (minimum 4 participants required for group tours)
- Force Majeure events
- Safety concerns
If we cancel a tour, we will offer:
- Full refund of all payments made
- Alternative tour dates (if available)
- Credit for future tours (with 20% discount)
4.3 Refund Processing
- Refunds are processed within 30 business days
- Refunds are issued to the original payment method
- Bank transfer fees may be deducted
- Currency exchange differences may apply
5. Changes & Amendments
5.1 Client-Requested Changes
- Date changes requested more than 60 days before departure: €50 administration fee
- Date changes requested within 60 days: treated as cancellation and rebooking
- Participant name changes: €25 per change
- Tour itinerary changes: subject to availability and additional costs
5.2 Operator-Initiated Changes
We may modify itineraries due to:
- Weather conditions
- Transportation delays
- Closure of attractions
- Safety considerations
We will provide suitable alternatives of equal or higher value.
6. Client Responsibilities
You are responsible for:
- Obtaining valid travel documents (passport, visas, vaccination certificates)
- Arriving on time for all tour activities and transportation
- Following instructions from tour guides and staff
- Respecting local laws, customs, and cultural norms
- Maintaining appropriate behavior that doesn't disrupt the tour
- Paying for any damage caused to property or equipment
- Informing us of any medical conditions, disabilities, or special requirements
7. Health & Safety
7.1 Medical Requirements
- You must be in good health to participate in tour activities
- Some tours may require medical certificates for certain activities
- We must be informed of any medical conditions that may affect participation
- You are responsible for carrying necessary medications
7.2 Travel Insurance
Comprehensive travel insurance is mandatory and must include:
- Medical expenses (minimum €100,000 coverage)
- Emergency evacuation and repatriation
- Trip cancellation and interruption
- Baggage loss and delay
- Personal liability
Proof of insurance must be provided before departure.
8. Liability & Limitations
8.1 Our Liability
We are responsible for providing services as described in the itinerary. However, we are not liable for:
- Events beyond our reasonable control (Force Majeure)
- Personal injury or illness during the tour
- Loss or damage to personal belongings
- Changes to itineraries made for safety or operational reasons
- Acts or omissions of third-party suppliers (hotels, airlines, etc.)
8.2 Liability Limit
Our maximum liability for any claim is limited to the total price paid for the tour.
8.3 Force Majeure
We are not liable for failure to perform due to Force Majeure events including:
- Natural disasters
- War or terrorism
- Strikes or labor disputes
- Government actions
- Pandemics or health emergencies
- Transportation failures
9. Complaints & Disputes
9.1 Complaint Procedure
If you have a complaint during the tour:
- Inform your tour guide immediately
- Allow reasonable opportunity to resolve the issue

- Submit written complaint within 30 days of tour completion
9.2 Governing Law
These terms are governed by French law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Bordeaux, France.
10. Intellectual Property
- All content on our website is our property or licensed to us
- You may not reproduce, distribute, or modify any content without permission
- Photos and videos taken during tours may be used for promotional purposes unless you opt out
11. Website Use
- You must not use our website for unlawful purposes
- You must not attempt to gain unauthorized access to our systems
- We reserve the right to modify or discontinue the website at any time
- Prices and availability on the website are subject to change
12. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms & Conditions, along with your booking confirmation and itinerary, constitute the entire agreement between us.
